PLEASE READ THIS SHORT AGREEMENT TO THE END. IT GIVES YOU VIEW-ONLY ACCESS TO THE LAWZENGE AGENCY CONNECTOR FOR COURT SCHEDULING AND ADMINISTRATION, LIMITS HOW YOU MAY USE WHAT YOU SEE, AND LIMITS LAWZENGE'S LIABILITY. BY CLICKING "I ACCEPT" YOU AGREE TO BE BOUND BY IT. IF YOU DO NOT AGREE, CLICK "DECLINE" AND DO NOT REGISTER.
1.1 Lawzenge. "Lawzenge", "we", "us" and "our" mean Nicholas Jacob of Vernon, British Columbia, operating as Lawzenge, and include any successor or assign of the Lawzenge business, including any company he incorporates to operate Lawzenge.
1.2 This Agreement. This Court and Crown User Agreement (the "Agreement") applies to Court and Crown accounts only. It is separate from the Lawzenge User Agreement that applies to lawyer and other members. You accept it by clicking "I Accept" when you register, or by using a Court and Crown account.
1.3 Personal acceptance. You accept this Agreement personally. It does not bind, and is not made on behalf of, the Crown, any ministry, the BC Prosecution Service, any court or your employer, and nothing in it limits any duty you owe to them.
2.1 Who may register. A Court and Crown account is available only to Crown counsel, judges and judicial officers, court staff and other employees of the Government of British Columbia or the courts of British Columbia who have a working email address ending exactly in @gov.bc.ca, @provincialcourt.bc.ca or @bccourts.ca.
2.2 Email confirmation. Your account starts only after you click the link we email to that address. Confirming the email address is the only check Lawzenge makes. You confirm that the information you give us, including your role, is true.
2.3 Personal account. Your account is for you alone. Do not share your password or let anyone else use your account. Keep your credentials secure and tell us promptly if you suspect misuse.
2.4 When eligibility ends. If you leave the role that made you eligible, or no longer have the qualifying email address, you must stop using the account and ask us to close it. We may also close it.
3.1 What you can see. Your account lets you view the Agency Connector: courthouses, courtrooms, dates, the Lawzenge lawyers who expect to appear and, where a member has added one, the presiding judge.
3.2 What you cannot do. Your account is view only. You cannot post, edit, delete, book or claim appearances, add judge information, send or receive messages, or use any other Lawzenge service. Your account is not listed in the Member Directory and is not shown to members.
4.1 Court scheduling and administration only. You may use information you see through your account only for court scheduling and court administration in the course of your duties.
4.2 No redistribution. You must not copy, publish, share, sell or otherwise redistribute information from the Site, in whole or in part, to anyone, including by screenshots, exports or lists, except as strictly necessary for court scheduling and administration within your own office.
4.3 Not an official record. All information in the Agency Connector is entered by members and may be incomplete, out of date or wrong. It is not a court record, a court list or a notice of appearance, and you must not rely on it in place of official court sources.
4.4 Judge information. Judge information is supplied by members. It must not be used for any improper purpose, including any attempt to choose or influence a judicial officer.
4.5 Client information. Members are told never to post client information. If you see anything that could identify a client or a court file, do not use or share it, and tell us at nick@nicholasjacob.ca so we can remove it.
You must not: scrape, crawl, harvest, download in bulk or use automated tools to access the Site; try to get around the view-only limits or any security measure; access accounts or areas you are not entitled to; use member information for marketing, solicitation or contact unrelated to court scheduling and administration; or use the Site in any unlawful way.
We collect your name, email address, role, court or office (if you give it), account activity and a record of your acceptance of this Agreement (including the date and time, IP address, browser information and the version and text you accepted). We use this information only to run your account, confirm your email address, keep the Site secure and keep records. It is not displayed to members or listed in the Member Directory. We handle it in accordance with applicable privacy laws, including British Columbia's Personal Information Protection Act.
Court and Crown access is free. We may change, suspend or end Court and Crown access, or any part of the Site, at any time.
THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OR CONDITION OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING AS TO ACCURACY, COMPLETENESS, AVAILABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, LAWZENGE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON INFORMATION ON THE SITE, AND LAWZENGE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THIS AGREEMENT OR THE SITE WILL NOT EXCEED FIFTY CANADIAN DOLLARS ($50 CAD). Nothing in this Agreement limits liability that cannot be limited by law.
We may suspend or close your account at any time, including if you breach this Agreement or are no longer eligible. You may close your account at any time by emailing nick@nicholasjacob.ca from your account email address. Sections 4, 8, 9, 12 and 13 continue to apply after your account ends.
We may amend this Agreement. We will post the amended version with a new version number and effective date and tell you about material changes by email or on the Site. We may ask you to accept the amended version before you continue. Your continued use after an amendment takes effect means you accept it.
This Agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. The courts of British Columbia have exclusive jurisdiction over any dispute about it.
Clicking "I Accept" after scrolling through this Agreement is your electronic signature and has the same effect as a handwritten signature under the Electronic Transactions Act (British Columbia). We keep an electronic record of your acceptance, including the details listed in section 6 and a digital fingerprint (SHA-256 hash) and complete copy of the text you accepted. You may ask us for a copy.
